Compulsory registration of NRI marriages for protection of women


HYDERABAD: External affairs minister Sushma Swaraj on Monday offered a Bill on Registration of NRI marriages which is able to offer higher protection to ladies married to NRIs. The invoice was offered within the Rajya Sabha.

The Bill is an end result of a joint initiative of the ministry of exterior affairs, ministry of women and child construction, ministry of house affairs and ministry of regulation and justice.


The goal of the Bill is to create extra responsibility and offer extra protection in opposition to exploitation of Indian ladies by means of their NRI spouses. It envisages (i) Registration of Marriages by means of Non-Resident Indians; (ii) Amendment of the Passports Act 1967 and (iii) Amendment to the Code of Criminal Procedure 1973.


According to the provisions of the Bill, the obligatory registration of marriage inside 30 days of marriage in India or in another country would provide better enforcement of rights of the deserted spouse below more than a few family rules. Similarly, the Amendment to the Passport Act would empower the Passport Authority to impound or revoke the passport of NRI, if it is dropped at his notice that the NRI has now not registered his marriage inside 30 days from the date of marriage.


The Amendments to CrPC, 1973 would empower the Courts for issuance of summons, warrants throughout the specifically designated website online of the ministry of exterior affairs. It also provides provisions for attachment of properties belonging to the NRI, if he does now not seem ahead of the Court and is asserted as Proclaimed Offender by means of the Court.


The advent of the Bill was necessitated by means of the ministry of exterior affairs due to a lot of court cases received from Indian nationals mostly ladies deserted or stressed by means of their Non-Resident Indian Spouses. The Bill proposes to supply higher protection to Indian ladies married to NRIs and serve as a deterrent to NRIs in opposition to harassment in their spouses.
